Definition

The Payment of Wages Act 1991 sets out the basic mechanics of paying Irish employees. Wages must be paid by an approved method (cash, cheque, bank transfer, postal order, money order, bank draft) and every employee is entitled to a written or electronic payslip with each pay date showing gross pay and the nature and amount of every deduction. Deductions are unlawful unless required by statute (PAYE, USC, PRSI, court orders), provided for in the contract of employment, or made with the prior written consent of the employee. Deductions for breakages, till shortages or losses caused by the employee require even stricter justification, must be reasonable in amount, must be notified at least one week in advance, and cannot exceed the actual loss. The Payment of Wages (Amendment) (Tips and Gratuities) Act 2022, which commenced on 1 December 2022, brought a separate regime for service charges and tips: mandatory written Tips and Gratuities Distribution Notice on display, fair distribution of cashless tips, prohibition on using tips to make up contractual rates of pay, and an unambiguous distinction between tips and the mandatory service charge. Complaints lodge with the WRC within six months. Awards can be the unlawfully deducted amount or up to the gross weekly remuneration in tips cases.

Most Payment of Wages claims are payslip and deduction errors that payroll software prevents by design. Irish-aware payroll with itemised statutory and voluntary deductions, electronic payslip delivery, and an audit log of contract-authorised deductions, combined with point-of-sale software that segregates the service charge from tips and supports a documented distribution policy, removes nearly all the litigation surface.
